Terms of use

Who we are

Kiwi Catch and Kiwi Hunt are made by Ben Drummond (Odd Hours Software) in New Zealand. Questions about these terms: email support@oddhours.co.nz.

The short version

The apps are free guides to help you fish and hunt in New Zealand. They are not the law, not a permit and not a navigation or safety device. Always check the official rules and conditions yourself, and use your own judgement out there.

These terms

These terms apply when you use Kiwi Catch, Kiwi Hunt or this website. They add to Apple’s Licensed Application End User License Agreement, which also applies to apps from the App Store. By using the apps you agree to both. If you do not agree, please do not use the apps.

A guide only

We write the rules in plain English from official sources and update them when we can, but rules change, and not every closure, rāhui, local bylaw, permit condition or season is included. The apps do not replace:

  • the official fishing rules from MPI and Fisheries New Zealand,
  • a Department of Conservation hunting permit and its conditions,
  • Fish & Game game bird regulations, or
  • firearms law and your firearms licence.

You are responsible for following the law, holding the right permits and licences, and checking the official rules before you keep a fish or hunt. The apps are independent and are not made or endorsed by MPI, Fisheries New Zealand, the Department of Conservation, Fish & Game or Toitū Te Whenua LINZ.

Safety

Tides, wind, legal light times, grid references, compass directions and maps are a guide only and can be wrong or out of date. They are not for navigation or for deciding whether it is safe to go out. Check the official forecast, tell someone your plans, carry proper safety gear, and in an emergency call 111.

Information from others

Some information in the apps comes from other organisations: tide tables from Toitū Te Whenua LINZ, marine reserve and hunting area boundaries from the Department of Conservation (licensed under CC BY 4.0), and weather from Apple Weather and Open-Meteo. We pass it on as we receive it and cannot promise it is complete or correct.

Your data

Your logs, photos and spots stay on your iPhone and in your own iCloud. You are responsible for keeping a backup of anything you do not want to lose. How we handle information is set out in the Kiwi Catch privacy policy and the Kiwi Hunt privacy policy.

Ads and purchases

The apps are free and show ads from Google AdMob. Kiwi Hunt has a one-off in-app purchase to remove ads. Purchases are handled by Apple through your App Store account, and refunds are handled by Apple at reportaproblem.apple.com. A purchase applies to the Apple ID that made it and can be restored on your other devices.

Using the apps

Please do not copy, resell or reverse engineer the apps, or use them for anything unlawful. The apps, their design and our wording belong to Odd Hours Software. Information from other organisations stays under its own licence.

Changes and availability

We may update the apps, change features or stop offering an app. We may also update these terms; the date at the top shows the latest version, and continuing to use the apps means you accept the update.

Our responsibility

We work to keep the apps accurate and working, but we provide them as they are, without any promise that they will always be available, error free or right for your purpose. To the extent the law allows, we are not responsible for any loss, damage, fine or injury that comes from using or relying on the apps, and if we are found responsible for anything, our total liability is limited to the amount you paid us for the app in the last 12 months.

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be excluded by agreement.

New Zealand law

These terms are governed by New Zealand law, and New Zealand courts deal with any dispute. If you have a problem, please email us first and we will try to sort it out.
